  • Expropriation of Water Lease in Dar es Salaam, Tanzania
    Biwater claimed US$20 million from the Government of Tanzania for expropriating a lease granted over the water system in the capital city, Dar es Salaam. Castalia presented expert evidence for the Government to an ICSID arbitral tribunal establishing that the lease-holding company had no remaining value. The tribunal accepted our arguments in its award stating (at paragraph 795) that “the correct approach to valuation here is that set out in the Castalia Report.” The tribunal made the resounding conclusion that City Water had no economic value and no award of damages was made. Castalia’s evidence was also accepted in a related proceeding heard by the United Nations Commission of International Trade Law, City Water Services v Dar es Salaam Water and Sewerage Authority (UNCITRAL UN6761)
  • Valuation of Interests in Power Purchase Agreement, Tanzania
    The Government of Tanzania is involved in a long-running dispute over payments due to the private owner of a 100MW thermal generation plant under a power purchase agreement. Castalia provided expert advice to the Government on quantum issues related to changes in the capital structure of the power producer. The case leverages Castalia’s experience analyzing private investment in emerging power markets and advising on power purchase agreements
  • Resource Planning Consent Hearing, New Zealand
    A major New Zealand supermarket chain planned to build a new supermarket in an area that had not been designated for such developments. Castalia presented expert evidence to try to overturn resource consents for the development, analysing the economic impacts of the construction considering the effects of increased supermarket competition and previously released city plans.
  • Nations Inc v Panama, Panama
    Castalia was retained as economic and financial experts for this arbitration before the International Center for Settlement of Investment Disputes (ICSID). Castalia prepared an expert report quantifying damages, and assessing the validity of the claimants' request for compensation. To arrive at an accurate economic valuation, Castalia analyzed the financial and operational performance of the power company involved in the case and applied a discounted cash flows analysis.
